The San Gregorio nude beach runs 7,800 feet from north to south. Going south to north on the beach, the POST-donated land fronts the first 3,900 feet (approx.) to the east. Under Calif. law, the dry sand portion (above mean high tide line) of the northern half of the beach belongs to the private property owners to the east of the beach. Under Calif. law, after 60 years of continuous use, the public has likely gained prescriptive rights to that dry sand portion. Left unsaid is that the beach is usually (90% of the time) terribly cold in the summer - today the high is 59F and overcast - water temps in the low-50s. Any visitor likely needs more than a swimsuit to tolerate the cold. Irrespective of stories of 500 visitors, I’ve never seen more than 2-3 dozen at the most. The picture appears to be the existing state beach, located to the south.
A State Parks spokesperson told Coastside News that “regulations for state beaches are intended to provide safe and inclusive recreation opportunities for all visitors and do not include clothing-optional recreation.”
The contradiction and inconsistency in this single statement is deafening!
Every military service person in America should be appalled at this sort of goings on. They fight for freedoms that are being stolen by bureaucrats and evangelists that have never read the Bible. If God turned up without clothes he wouldn't be accepted in the US of A!
Well, the answer to begin fighting for what is being lost is in the originating history outlined in your article.
Lawyer up. Gather 500 nudists again each and every Sunday, have a spokesperson arrested and be prepared to remind the court of the precedent on nudity set by the Supreme Court.
Access must be allowed to continue as the law states, nudity alone is not illegal unless accompanied by lewdness.
